Our attorneys have represented a wide variety of clients in a diverse range of matters.  Our attorneys routinely handle complex real estate transactions, including acquisitions, leasing, dispositions, and Note purchases. We also have significant experience in both state and federal court litigation, including creditors’ rights litigation, business litigation, lender liability litigation, enforcement of judgments and debts, landlord-tenant and lease disputes. In addition, we have represented numerous secured and unsecured creditors in bankruptcy proceedings, as well as assisted a business enterprises of all sizes with debt restructuring and out-of-court resolutions.

Our experience includes:

Negotiation and preparation of real estate transactional and financing documents, workout agreements, deed-in-lieu agreements and forbearance agreements.

Representation of institutional clients in connection with all aspects of contract, guaranty and judgment enforcement, including litigation, obtaining prejudgment provisional remedies, judgment debtor proceedings, and coordinating and conducting UCC foreclosure and third-party sales.

Representation of state-court receivers in both “rents and profits” and equity receiverships.  Representation of federal equity receivers.

Representation of institutional clients, including lenders, landlords, joint venture partners, and other business enterprises, in bankruptcy litigation, including fraudulent conveyance actions, preference recovery actions, and disputes over executory contracts.

Representation of commercial landlords and property managers in tenant disputes, including actions to recover possession, actions for damages, bankruptcy proceedings, arbitration, and mediation.

Representation of lenders in connection with judicial and nonjudicial foreclosure proceedings, receivership actions, and lawsuits involving various lender liability issues, including breach of contract claims, disguised financing transactions and usury allegations.

Representation of purchasers and sellers in Note sale transactions, including the subsequent Note enforcement and foreclosure proceedings.

Advice and counsel to, and negotiations on behalf of, small business clients in connection with debt restructuring and orderly liquidation of assets.
